Photo of the Day
August 7, 2008 by Marc Lamont Hill
Today’s photo of the day also doubles as our Embarrassing Negro Moment. Charged with aggravated murder, Tremayne Durham was facing life in prison or the death penalty. Like many people in that situation, he copped a plea. What did he ask for? FRIED CHICKEN!!! In exchange for an order of KFC and Popeyes (along with two sides!!!) Durham agreed to a life sentence. For those who think he gave in to easily, he will receive an pizza and lasagna at sentencing.

Now this is one of those stories that’s too insane to be true but actually is. Oh it’s very real wyltk and according to The Oregonian “Deputy District Attorney Josh Lamborn said Multnomah County Judge Eric Bergerston made the right call in allowing the unusual plea agreement because it saved the expense of a trial and possible appeals.”
And Marc dude is also getting calzones and ice cream. It’s ironic he’s getting ice cream considering that was the reason he killed the guy in the first place. He paid for an ice cream truck, changed his mind and killed the employee because he couldn’t get a refund.

I’m sure there is more to the plea deal that we’re not hearing about. I mean, we should be happy that he plead guilty and is owning up to what he did and I, for one, don’t blame him. The way prison food was described to me was “take hospital food, leave it outside for 4 days then microwave it”

I can’t joke about this, as this man needs some serious mental health intervention. If he had received it earlier in his life, his victims might still be alive and he might not be facing life behind bars…..sad…

From the reports I read on this incident: this guy WILL NOT receive KFC or other fast food in lieu of prison food, he will get the same slop everyday, for life, as the rest of his prison peers.
The fast food was given to him on 2, only 2 occasions, while they were concocting a plea deal.
I doubt this guy knew what he was agreeing to, and I doubt he received due process or any other constitutional rights.
I think they starved him during questioning and plea deal talks, and he just signed whatever to get some food. (that would be duress)
I wish there was a black leader, with direct and intimate access to media appearances, to look into this matter further.
But some just enjoy a good laugh off this sad, sad, sad case!
In my humble opinion, the “Embarrassing Negro Moment” is in the fact that black people are laughing at this uneducated, mentally ill brother, instead of fighting the powers that have obviously taken great advantage of his ignorance.

Tanya we have no reason to believe that he is mentally ill or was denied his constitutional rights. “Normal” people do odd, stupid things all the time. It is very well possible that this guy is completely sane and aware of his rights but was also
1)guilty 2)had a boat load of evidence aganist him
and so said screw it, bring some chicken and pizzas to my hearings I’ll sign the plea agreements. Stranger things have happend.

Maybe this guy has some sort of mental disorder? I’m not joking things are not always the way they seem or are reported.

Jazzy,
Stranger things have happened.
However, this man has been evaluated by psychiatrists before, and has been declared mentally ill.
According to Deputy District Attorney Josh Lamborn, this dude is “an anti-social psychopath”.
Like I said, I read the report, and I feel this man may have been deprived some constitutional rights.
Now Tremayne may very well be guilty. But there is an order of law to follow in rendering appropriate judgment in a court of law. If this man, black man, was denied any of his rights and that order of law not followed to a tee, it will set a very dangerous precedent and affect the rights of the innocent, a black innocent, who is wrongly accused later down the line.
But hey, keep laughing at your own people! Keep laughing at the hungry, mentally ill black man, who most likely got duped!
I’m just not laughing with you.

So Tanya where are these reports you say that aren’t consistent with what has been reported by the local paper covering the story (The Oregonian) and the national reports (Associated Press)?

Tanya I haven’t read any police reports or any reports other than what Marc printed above so based off that information I am not willing to assume that he was straved, tortured, or mentally ill. I understand very well how biased the justice system is to minorities and poor folks but that doesn’t mean that this particular black man has been victimized by the police. There is very good possiblity that he is just a cold blooded killer.

I have made several trips to court recently, following the trial of a man who admitts to fatally shooting my friend. On my last court visit the accused accepted life without the possibility of parole in exchange for not facing the death penalty in a trial. Through his attorney he sent me a message that he was sorry for what he did. My friend’s life was wasted and so is the young man who shot him….very sad.

if i were you, i’d ask for an additional requirement, that a group of cops must walk to Junior’s from Philly, to get that cheesecake….and pay tolls.

What are you talking about dude???
I never said any reports were not consistent with what was reported in the local paper or the AP!!!
In fact, the AP, and several local and national papers have indeed reported that this man is mentally ill!!! It’s not a secret. The Oregonian has stated directly that this man was declared mentally ill by a psychiatrist.
Further, anything that takes place in any court, anywhere in this country is NOT a secret. It is all public record. You and anybody else could look up the court submitted reports on this dude, and the proceedings in this case.
I believe some of his constitutional rights may have been denied and violated, and I simply stated such.
The fact that he’s mentally ill raises additional skepticism. Do you really think a mentally ill person is fully capable of making ideal decisions or asserting their own rights???
BTW – Several mentally ill people have committed murder. They take the insanity plea, and NEVER do life in prison. BUT this BLACK man WILL do life in prison!!!! This will only raise flags and set off alarms in anyone who has common sense, whether a request for KFC was made or not!

You shouldn’t be willing to assume anything. You should be willing to do additional research on everything before you to subscribe to anything.
If you fail to do your own research, you will fail to reach the truth. Like you did here.
Marc never mentioned that this man was mentally ill, but the fact remains that this man is indeed mentally ill.
But don’t take my word for it, do your own research!
